Whirlpool tub disconnect

I'm installing a whirlpool tub that draws 27 Max Amps. It also requires a 120 volt circuit with GFCI protection. My supplier called eaten and they said a single pole 40 amp GFCI breaker is something that's ordered special from the factory and it's made to order. My question is can I use a 2 pole 40 amp GFCI breaker for a 120 volt circuit and will it function properly in the event of a ground fault. I know that you can use a 2 pole GFCI for a spa panel and it will protect 120 volt circuits. Also the whip is a hard-wired connection. What are the rules for locating the disconnect. Does it have to be in sight or can it be on the adjacent wall in the bedroom outside the bathroom or can it be underneath the access panel of the tub? Thanks for your help in advance

As long as it is the 2 pole breaker with a neutral connection.
