Who IS responsible?

I have NEVER had this problem for the last 9 years in business here in California.
I subcontracted for the electrical work for a room addition. The prime signed my estimate. After ALL my work was complete and waiting for final inspection, the prime stopped work and placed a lien on the customer's house. (The prime wanted his final payment BEFORE all the work was completed. Stucco, drywall, and plumbing.) The prime tells me that he does NOT have to pay me unless the home owner pays him first. A legal adviser tells me that I have NO recourse against the prime. But I do with the home owner and need to lien her house also.
Can anyone give me any practical advice here-PLEASE?
 
You need a lawyer. You'll also need to decide if the cost of legal work is justified based on what you're owed. Sometimes you just have to claim it as a loss and walk away.
 
Some contracts for sub-contractors have a "pay if paid" clause. If so that means if the general doesn't get paid, then the subs don't get paid.
 
This is exactly why I use my own contract. Who ever contracts with me signs my contract and paymants are made as stated, no ifs ands or buts. I do not sign anything from the contracting party, everything is spelled out in the my contract and everyone involved signs it.

In my town it is stated on your permit that, "contractor will not receive final payment until final building inspection is passed"..

I find it strange that the prime can demand final payment without completion of final work...

Now, where is that sullivan guy, and his remarks about only lawyers being able to provide legal advice. I would have thought he would be all over this topic.
