If the conductors and OCPD are sized per nameplate and or manufacturers data, there should not be a problem.

I would venture to say this is fine, the # 8 conductors would cover the 40 amp load and the 50 amp breaker could probably even be larger.
However, Luke and Electricman 2 are correct that the manufacturers info should be followed.
