Wiring of wet niche fixtures? Permanently installed pools.

I have been seeing contractors wiring wet niche lighting fixtures using K-copper piping (tubing) or what ever it is called. When I wrote the violation I was told that the K-copper was a better way of wiring wet niche fixtures. I'm sure that can be debated both ways. My understanding is that we are to use conduit based on 680.23(B)(2). What say you counselor?
 
This is one of those I don't know things. If the K-copper is approved for pools then I would probably go with it but it is not one of the conduits listed so technically it should not be used. 680.23(2)(a) goes on to say the metal piping should be of brass or other approved corrosion resistant metal. I guess copper may work if approved. My problem with the copper is the softness but that may not be an issue.
 
It looks like to me that K-copper tubing is a plumbing tubing. I am suspicious of this as a conduit allowed for electrical. I think I would reject this install also.
