I am calling this a hazard regardless, but am I also correct that this violates 406.8?

406.9(C) Bathtub and Shower Space. Receptacles shall not be installed within or directly over a bathtub or shower stall.

We can debate the hazard, but 406.9(C) seems pretty clear that it's a "no-no."
