Working clearance above Panels

Good day gentlemen,

I have what I believe is a violation of 110.26(F)(1) see the attached photo. The drip pan is there to serve a water line above. The engineer is claiming this is permitted by 110.26(F)(1)(B). That’s not the way I interpret the code. What say you guys? The top of panel is approximately 6’’ off the floor.

If you're referring to the dedicated equipment space required above the panel the minimum dimension to the pipe is 6'. It is not a working space problem.

Agreed dedicated equipment space, not working space, my mistake. But the minimum dimension to the pipe or the drip pan should be 6’ from the top of the panel.
 
What's with the 2 offset nipples and the rigid coupling?
Existing, I couldn’t say for sure. Speculating, its what they had available or to lazy to get the right stuff. I have yet to perform work in this closet. If I read between the lines the pipe above had a leak and the MCB panel on the left was replaced and a drip pan was installed to prevent further issue. The drip pan screws me a bit as the fit out is beginning.
 
From the picture I can't tell how far the pipe is off the wall. If it is actually over the panel(s) then it would be a violation of 110.26(E)(1)
(Assuming a cabinet depth of 6", if the pipe is 6" off the wall, then no violation)
