Receptacle Outlet Spacing

Are we required to install a receptacle outlet in the face of a built in bench in a breakfast nook to meet NEC 210.52 spacing? The bench is built in on an exterior wall. I would argue that the benches are 'fixed cabinets' per 210.52 (A)(2)(1) and thus do not count toward the measurable space.

Thoughts?

I?ve been burnt on this one before.

Here?s what was said, if you break the floor horizontal distance (with your whatever) it needs to be accounted for, or the horizontal distance is increased thus you have to add for the difference of the additional obstruction.

Here?s the example, kitchen circuit in breakfast nook, size about approximately 8x 8. Open one side, then windowed Brick exterior wall, interior brick wall, then a kitchen bar counter open face with a raised level verses lower appliances beyond the length of kitchen area. So the bar side made it a peninsula.

Here was the receptacle layout, one on end of the peninsula, one receptacle facing breakfast nook, one on interior brick wall, and one on exterior window wall, here?s where inspector got us!

The breakfast area had a bumped out column of brick, 2 bricks deep x 2 length long.

Granted the lay out was tight to begin with but the bump out it added enough inches to mess with the layout! The inspector measured linear adding the bump out and not just down the wall.

Not unlike your situation.
