Question on 334.10

In my area their is an existing 5 story condo building wired on the 2005 code a short time ago and it is all in MC cable. My question is since I cannot find this requirement in the 2008 code (but maybe Im missing something)...Is it permissible to run NM cable in a non firewall in this building to add Under counter lighting? Thanks
 
what type of building construction? Type I, II, III, IV, V???

What is the condition of occupancy?? Dwelling? Mixed, (is it all condos??)
 
The three story has been gone for years but depending on what code cycle you are under it may apply.

The change was before the 2005
 
This building is all condos and we are under the 2008 here.
You need to contact zoning or inspections and see how they classified the building. Then read 334.10 and see if nm cable will work. The inspections or zoning are the only ones who can classify the building for you.
 
I agree with Dennis. Talk to your AHJ to find out how the building was classified (that is....the type of construction). When you look at 334.10, you see that NM is allowed in construction types III, IV, and V except as prohibited by 334.12. These three types can have combustible material in them. Under 334.10, FPN No 2 directs you to Annex E where you get some guidance on height limitations based on the construction type and whether rated, non-rated, or sprinklered. (But the AHJ or the original architect would classify it)

So, as Dennis stated, if the classification is one of the three construction types allowed, and you meet the other criteria in 334.10, you may be able to use NM cable.:roll:
