Does travel time have to be paid at time and a half if the total of worked time and travel time is over 40 hours?

1 hr travel in am
8 hrs work
1 hr travel in pm

10 hrs total per day for 5 days.

40 hrs worked
10 hrs travel

Does the travel have to be time and a half?

I'm not asking what you think, I am asking what the law is.
Also is this part regulated by federal or state law?

also if you are union you will have their rules to go by as well.

a very common arraignment is to pay windshield time at straight time rate.

i've been in this situation as a foreman, and i put myself down at straight time rate
for the drive... but i was also getting up at 5 am, and going to bed at 1 am, and six
hours of that was windshield time... the rest of it was on the clock...
six days a week, and half day on sunday to get the next week lined up....

i'm not driving anywhere for minimum wage, but that's just my thoughts on it.
 
I believe an employer can pay minimum wage for the drive time, which would significantly drop the hourly overtime cost.

For the record, I don't pay minimum wage for driving, I just stated you could.

With traffic what it is now, drive time can be a big lost time problem though. We try to get to the job @ 7am, and leave @ 3:30pm, to ease the commute traffic problems.
