Service Supply Conductors

Code Question.. Recently saw a new install with service supply conductors connected to the utility on the south side gable of a building. They entered the building at that point via weather head and schedule 40 PVC. They travel approx 40' through non-accessible scissor trusses, that are insulated and sheeted with OSB on the bottom side, in the PVC and then exit the gable on the north side via LB and down to the the 400A CT cabinet. The panel is located directly behind the CT cabinet location. The question would be in regards to the conductors in the trusses hooked directly to the utility with out any OCPD. Thoughts?

Here is the art.

230.70 General. Means shall be provided to disconnect all
conductors in a building or other structure from the service entrance
conductors.
(A) Location. The service disconnecting means shall be
installed in accordance with 230.70(A)(1), (A)(2), and
(A)(3).
(1) Readily Accessible Location. The service disconnecting
means shall be installed at a readily accessible location
either outside of a building or structure or inside nearest the
point of entrance of the service conductors.
(2) Bathrooms. Service disconnecting means shall not be
installed in bathrooms.
(3) Remote Control. Where a remote control device(s) is
used to actuate the service disconnecting means, the service
disconnecting means shall be located in accordance with
230.70(A)(1).

I agree with Dennis. If the SEC's must be enclosed within the finish of the building then the service disconnect must be installed where connected to the utility on the south side gable of a building unless you want to encase the raceway in concrete.

That probably won't happen....
How long has this been in the code book? any idea?
