Wrong application

I have a guy who wants to use type SER cable as type SE cable and just cut off the extra wire. I made him change it but what backs me up in the code.

I agree with Augie. Just remove or safe off the unused conductor, nothing would prohibit have 4 conductors instead of 3 even if one is unused.

Just like using 14-3 and not using the red conductor at either end. Or pulling "future growth" wires in a conduit.

Here begs the question...
do you call the guy up before he changes it and tell him to leave it?
Do you call the guy up and apologize for being wrong?
Do you not do anything and make him think HE is wrong?

Both of the first two, definitely.

The third never happens with me.
