Controlling a 277V Light and a 120V Fan from a single 2-pole switch

I am using a 2-pole occupancy-sensing switch to turn on a 277V light and a 120V fan in a commercial restroom. Someone mentioned this violates NEC 404.8 C. I was under the impression that would be the main reason for having a 2-pole occupancy-sensing switch. I never measured more that 300V between any two contacts. Is this a code violation?

I don't see it as a violation.

The switch would need to be rated for 277V and also listed to serve more than one circuit.
