Outside tap conductor

An outside tap conductor does not have to be sized per the main breaker, is that correct? I have an interesting situation, please see the attachment. Therefore the one 350kcmil going to the house does not have to be sized for 320A.

Does anything else about this design stand out as against code?

I am in agreement, if there is no overcurrent device at the meter the install is fine although an EGC would not be needed.
(I don't see the problem as a feeder but electrofelon can enlighten me)

OK, I think you are right it is OK as a feeder. For some reason I was thinking the 1st part was a feeder tap and then you would be tapping that tap twice, but the 1st part is just a feeder not a feeder tap, so you can tap the feeder twice.

So if I had paralleled 350's to the house would it be compliant?
 
IMO, it would be compliant as dawn provide the "tap" at the jbox included all conducctors
