Mast under a gutter

Is there a code regarding a service mast under a eve on a house?

The house is a old house an as 3” eve’s, problem is they put the gutter up and the weather head is behind the gutter. Lady is selling and HI for buyers mentioned this. Is there anything that can be done, short of putting the mast though the roof?

Yes that’s a opening window and I know about the 3’, but the question is about the gutter

Cut 12 inches or so out of the gutter add cap both ends . Put 90 degree metal under shingles above to divert water. May need a down spout at one end
 
It's going to have to go up through with a mast, probably only 3 feet, though I don't see much room behind that gutter. What does the rest of that side of the house look like? Could you move the service? Could they build out the eve so you could get your conduit behind the gutter?

Would there be any wording I could use to say it’s safe without going through the cost of a new meter base, mast, cutting a hole in roof, etc, so she can close on the house?

It appears to me that the service conductors may be pinched. If that is so then I would say it is an issue. She can certainly close but she may want to think about getting it repaired and/or getting the previous owners to pay for it.

New buyers want her (owner now) to fix, wires are not pinched at all, I can move them back and forth

I think if they want it fixed right you're going to have to go up through the roof line somehow. Best bet is maybe to cut out that section of gutter and eave, and the patching up that would be required afterwards. Not something you can probably do yourself. Otherwise just leave it alone. Looks like it's been there a while.

Could you put a pole up next to the house?

That doesn't matter since it is above the window.

230.9 Clearances on Buildings. Service conductors and final
spans shall comply with 230.9(A), (B), and (C).
(A) Clearances. Service conductors installed as open conductors
or multiconductor cable without an overall outer jacket
shall have a clearance of not less than 900 mm (3 ft) from
windows that are designed to be opened, doors, porches, balconies,
ladders, stairs, fire escapes, or similar locations.
Exception: Conductors run above the top level of a window shall be
permitted to be less than the 900 mm (3 ft) requirement.
 
I would go though all of the various clearance requirements in the NEC, the NESC, and the utility installation manual.

It looks ugly, and I would be concerned about the service conductors chafing against the gutter, but I don't know that there is an explicit code violation.

This isn't a service mast that supports the drop; whatever mechanical attachment that holds the weight of the drop is somewhere out of the picture. What we are looking at is the loop of conductor from that attachment point to the weather head.

The simplest repair might be to _lower_ the conductors, if the utility clearance requirements permit, simply moving the point of mechanical attachment to properly maintain clearance between conductors and the gutter.

I would consider just shortening the conduit a couple of inches, or shortening it and adding an elbow to bring the weatherhead to the left, toward what appears to be the point of attachment, keeping it below the gutter..
 
shorten raceway enough to clear gutter.

If conductors are not rubbing on gutter, there kind of isn't really a problem other than it just looks strange.

If open conductor clearances are not enough as is, it sort of needs raised whether the gutter was there or not, but possibly wouldn't been questioned if it didn't look out of the ordinary.

Did the home inspector quote a specific violation? I agree that its ugly, but I'm not sure there is any violation if it meets the clearances.

There's the old saying about people who want ice water.....
