10' tap rule, 240.21

The question is in reguard to the location of a disconnect/circuit breaker for the tap conductors. If a 350a fused disconnect is being tapped from an 800a disconnect, can the 300a disconnect be in a different room, and within 10' of the 800a disconnect? Or, in other words, can it be out of sight, but within 10' from the tap?

I also do not believe the NEC prohibits what you are saying
 
But you do have to remember that the 10' is the wire length from termination to termination and not the distance between the two enclosures.
