110.26 Part A Question?

I have a question on the enforcement else where on 110.26 part A. Working space is specified as "likely to require examination, adjustment, servicing, or maintance while energized shall comply with the demensions of Etc Etc Etc.
My question is if a remote local disconnect is installed should this apply to a above ceiling mounted air handeling piece of equipment? As most of us know ceiling space in a small area is tight making this space requirment impossible. It is my interpetation that the local disconnect allows the user to safely disconnect power prior to opening the unit. Does anyone agree that this section of the code should not apply to this application?
 
Up here it depends on the jurisdiction. A couple of cities will make you clear everything in front of the unit and install removable grid to access the VAV's and FB's, while other jurisdictions could care less.

As Ryan says, it's the AHJ's call.
