120 percent rule for sub panels

We have a 16 hundred amp switch gear, from 200 amp breaker in switch gear it goes to 200 amp sub panel, can I only back feed 40 amps if I tie into sub panel, and if max 40 amp is there another way besides derating and going straight to switch gear

This rule applies to all subpanels throughout the system from the point of interconnection to the service point.

The work-around to this rule, is to do a feeder tap within a tap rule's length from the main breaker of the subpanel, and locate the PV system nearby.
