2 pole 30 homline breaker and #8 AWG

Final got tagged today for oversized conductor,AHJ cited 240 4 D on correction notice,and wrote oversized conductor for breaker.SQ D homeline lists there 2 pole 20!s and 30`S as Ul listed as rated from # 14 to # 8,I nextelled the inspector and asked whats up he said that the NEC didn!t allow this as per 240 4 D
What did he read in this that I am not ;)

He cited 240.4(D)...great send it right back to him.

240.4(D) Small Conductors. Unless specifically permitted in 240.4(E) through (G), the overcurrent protection shall not exceed 15 amperes for 14 AWG, 20 amperes for 12 AWG, and 30 amperes for 10 AWG copper; or 15 amperes for 12 AWG and 25 amperes for 10 AWG aluminum and copper-clad aluminum after any correction factors for ambient temperature and number of conductors have been applied.
"shall not exceed" is not the same as "shall be"

This would be funny if it was not a big waste of your time. :eek:

Bob this all started when one of our trim guys clipped a couple of conductors off of 6/2 nm to fit under a 2 pole 30 homeline.Ok thats a no no.Tag a piece of # 10 and be done with it!His doings were corrected.So a few weeks pass and now this,I emailed SQ D when this happened to get max. wire size allowed under these type lugs.# 8 max. UL listed.The tag was for a wall oven wired in 8/3 NM but fused at 30 amps.Oh and as far as my time is concerned I left the house at 545 am and got home at 615 pm I dont have time for this :mad:

How would a say an 8/3 or 8/2 violate the code that you quoted?

Jeff,
The section Ryan cited will require a #8 EGC in a cable with #8 ungrounded conductors connected to a 30 OCPD. The #8 cable will only have a #10 EGC.

The AHj consided if listed and thet were then no problem :D I won
