2008 NEC Article 410.73 Disconnecting means

I have an existing facility in which I have to replace flourescent lighting. I am going to repalce the old fixtures with the T8 system.
Do I have to abide by the new code since this is not a brand new installation?

I don't think you will get a decisive answer here.

In my own opinion your replacing a ballast that now requires a disconnecting means, I would include it in my price and install it.

I believe it was moved to 410.130(G) in the '08.

It is 410.73(G) in the '05.

If by chance you're in CT, which is still on the '05, 410.73(G) was amended out by the state building code.
