Assuming a 20 amp MWBC is used in this picture, isn't it a violation of 210.21(B)(3) to use a 15 amp duplex receptacle?

It looks like a violation to me. It's a split wired 15 amp duplex receptacle so each half of the duplex shall be protected by a max of a 15 amp overcurrent device. Per 210.21(B) (3).

Yes I think so. Each receptacle would be the sole one on each cicuit.
 
I think if you go by the wording of the code you are not required to have a 20 amp recep. , however I would only guess that the intent would say you need a 20 amp device.

Read the definition under recep. and that is your ticket but I would not bother to go there-- just install a 20 amp device.

I'm sorry, IMO there is no violation of 210.21(B)(3).:smile:

Edit, I see MWBC. I retract the above and would have to say Yes, we have a violation Your Honor.

By definition,a MWBC is a single circuit (Art. 100). It is allowed (but not required!) to be considered two circuits in 210.4(A)
