And in my opinion if the it is used as an 'auxiliary gutter' but the UL tag says wireway it is wireway and a raceway.

I think I missed something here.
I think I missed the 'intent' of the NEC.
Is it true that the Service (before disconnects)
and the and the Load (after disconnects)
are not to be in the same enclosure,
because of the possibility
that a Service Fault (before disconnects)
could be carried
directly into the Load (after disconnects) ?
(My choice of words is not the point,
only the safety "intent" of the NEC.)
My approach to the many interesting
electrical considerations found in these forums
is to approach from a Physics side, and a safety side,
and allowing that perspective to guide me
as I try interpreting what the NEC states is safe.
