True. The nec doesn't highlight everything that is objectional, and what is objectional to one inspector might not be to the next. But I agree with you, I am just looking at reasons why one might not agree that 250.85(3) allows 3 wire after the emergency disconnect, with objectionable current being one reason. Now there would be another enclosure on the line side of the service disconnect bonded to neutral.
