Not really. List items 300.3(B)(1) through (B)(4) act as exceptions and 300.3(B)(3) would permit that installation.

Good catch, I have seen it done and even done it myself but always thought it was a violation.

So does anyone makes NM cable with an insulated ground?

Yes. I had a house wired in the late 60s that had nm cable with an undersized ground and it was green insulated. I've never seen it for sale though.
