3-phase 4-wire non service rated automatic transfer switch

the main 3-phase 4-wire feeders are 3 parallel 500 MCM connected to a 400-amp main.

My goal here is to remove the buss bars connecting the top of the 400-amp main breaker to the buss bars feeding breakers above it. I am going to install lugs on the top of existing 400-amp
breaker. Then install one 500 MCM line per phase to transfer switch line side. Then from load side
of transfer switch one 500 MCM line per phase to lugs install on panel buss bars. Looking in the codes to check if this is with in code or not.

This will be entirely up to the judgment of the inspector to allow or not.

Personally I would find another way.

I think most inspectors would view that as altering a listed panel and find it unacceptable, but as iwire states, AHJ call.
