This code has always been confusing on how to apply its rule

Apparently an enclosure such as a breaker panel (although appears not aesthetically pleasing neets code) is allowed to have splices made in it

Conductors in the cabinet are allowed to fill 40% of the space containg it

However add a splice here and all of a sudden you can fill 75%
 
Is that a question or are you just making an observation? For what it's worth you even if you tried you could not exceed 75% fill with splices in a panel.
 
I would say the 75% vs the 40% is to allow for splicing devices.
Normally the splice is just a small portion of the overall gutter so the 75% creates no problem whereas a 75% overall gutter fill could be problematic
 
I'm surprised it allows feed thru conductors from another source in a panel. I saw a 40 circuit and space panel with 50-60 circuits in a new installation and mentioned it to the electrcian and he said he was installing a subpanel and splicing them thru. He had no knowledge of NEC and I ignorantly said you couldn't use the panel as a feedthru or splice box but then went to my truck for... . Apparently you can
