Looks like a good solution. :)
I've used similar 30 amp versions. What size condcutors are you using?
 
2 space loadcenter with breaker and flush cover are an option and may cost less.

Rob, was going to run 2 #8's with a #10 ground.

Run is 70 ft.

Finished conduit today, lots of saddles and offsets/kicks to get there but fishtape is sitting in pipe waiting !

That switch says non grounding in the link you provided.
 
I am not saying that, all I am saying is I don't think the specific requirements of 404.9(B) apply here.

It seems that the only way to actually ground this device (call it a controller or a snap switch) is by the mounting screws.
 
what about a breaker lock?

I don't think a breaker lock would fly around here. It's
a line of site disco they ask for. The NYC amendments to the NEC contain
a bit of voodoo :cool: Interesting about the grounding aspect of "controller" however,
--we ran a green #8 also, and will bond that to boxes along the way, but, yes, the yoke screws are the grounding for 40A switch.
 
Installing 40A 208V tankless HW heater for commercial bathroom.
Architect wants disconnect switch to be flush with wall. There's not
really a good place to put access door for disco in wall.

Looks as if it would mount in 5 in. box with 1G mud ring.

Has anyone used one of these before ?
