In the 2002 handbook the highlight under 440.21 states that an air conditioner with a nameplate that reads (max fuse size only) restricts the unit to fuse protection only and does not cover its use with circuit breakers which would require fuses ahead of or a fused disconnect to be installed instead of a no fuse at the unit.I do not see this passage under 440.21 in the 2002 codebook,,,,,is it somewhere else? does the handbook take presidence?

The Handbook does not take precedence. In fact, on the copyright page under "Notice Concerning Formal Interpretations," it will tell you the Handbook only reflects the personal opinion of the authors.

That being said, the 440.21 commentary clearly cites the NEC Section [110.3(B)]that supports the interpretation. The UL listing process creates the restrictions mentioned.
