Hey all I'm installing a Tesla fast charger and was wondering if a service disconnect is required and if so can it be a non-fused disconnect and what about a surge protector

The details you ask depend local amendments of nec in NYC. As you NYC electrician, you get nec amendments details easily

If the charger is not more than 60A, no disconnect is required.
Surge protection would not be mandatory.

625.43 tells us when an EVSE disconnect is required by Article 625. If some other Article would require a disconnect for an EVSE when Article 625 does not, then that's most likely a coordination failure within the NEC.

A Level 2 EVSE is just a fancy receptacle, and receptacles don't usually require disconnects.

60 amperes or more than 150 volts to ground, the disconnecting

location. The disconnecting means shall be lockable open in

You're correct because the unit is less than 60 amps. The OP never mentioned voltage so it's likely that it is not 277 or 480.

I always read it to be disco required regardless. I.e. - breaker in panel with lockout fine for ≤60a but over 60a it had to be within line of sight (if panel was more than 50ft away (?)

The section I posted doesn't say that. It just says greater than 60A needs a disconnect.

The question was asked in the NEC forum, so you get NEC answers. Local codes cant be known by most of us. Certainly the OP should check for relevant local codes, but there may not be any for this exact question.

For EVSE and WPTE rated more than 60 amperes or more than 150 volts to ground, the disconnecting means shall be provided and installed in a readily accessible location. If the disconnecting means is installed remote from the equipment, a plaque shall be installed on the equipment denoting the location of the disconnecting means. The disconnecting means shall be lockable open in accordance with 110.25.
