54 circuit panel

anyone else run into a service panel 54 spaces? this is a qo square d 120/208 volt 3 phase 225 amp panel. actually has 55 circuits in it. (one tandem breaker). When did the code change to 42?
 
408.15 addresses the number of OCPD in a "panelboard"

It should be noted that switchboards, unlike panelboards, are not limited to 42 overcurrent devices or 42 switches or devices.

Question is:
What do you mean by a "service panel"?
 
I have used a number of these in the past normally in commercial kitchens, the additional spaces make room for shunt trip breakers.

It looks like in 2008 it will be a non-issue anyways

You could fill an I-Line panel with QO adapters and put hundreds of breakers in it. The 42 circuit limit is for the installer, not the manufacturer.
