I would not be so sure it depends on what code your on if your on the 2023 you experts might want to check 680.7, my boss said next time someone has pre wired AL for a spa we just pretend its not there, he ran into a similar issue the original GC of a new home had charged the customer to prewire for a future spa, he had installed a empty little 3R sub panel fed with 6 AL SER.
Same inspector that approved the panel said it can't actually be used now, he was requiring a insulated copper equipment ground wire for the feeder, when asked why he did show us the code 680.7 so if the feeder is in a wet location under the 2023 it must contain an EGC with an insulated copper conductor

When asked why he approved the panel in the first place he said he the spa was not there at the time and the new 2023 NEC moved that requirement to the part that also covers spas.
He also would not approve running a separate insulated copper ground on the outside of the feeder so the entire feeder had to be redone.
