ive seen this problem with a couple "neverending" swimming pools i hooked up. even though the water fell over an entire section of the pool into a collecting pool i decided just to make the deck as the max level for saftey sake. even a stationary hurricane probably couldnt produce enough rain to abruptly overflow the pool, it was better safe then sorry. my biggest concern out of anything was the fact that the tube for the float that controls the water level is always right next to the pumps or compool panel's etc...
my personaly opinion, call your local inspector and ask what he would like to see. maybe he can give you some more insight.
