The panel changed the reference to just 110.26(A).
Thanks Don. I really don't know why this was ever even debatable but I'm glad that it's been "fixed" in the NEC.
 
If it's not likely to be worked on while energized then it wouldn't matter I use a non fused pullout switch for that reason.
How does a non-fused pullout save you from working on it while energized? If there is a VFD, then it might be large-ish and have higher fault current available than 5kA, so you would need a fused switch to have an adequate SCCR.

If anything the fused disconnect would at least allow you to test the fuses when is was de-energized. With a non-fused disconnect you would need to test it while energized.
