If a project(residential dwelling) is underway(drywalled) and the state has just adopted 2008, is the code based upon when the permit was pulled or is it a moving target. Can the inspector require that changes be made to bring the dwelling current with 2008?

Date of permit here.

In New Jersey all permits are inspected under the code in effect when the permit is applied for. Also there is a six month grace period after the adoption of a new code. In this grace period the applicant can design by the new or previous code.
