AFCI Breakers in service replacement

I do residential service installations and after receiving my new 2008 code book there was some confusion regarding AFCI breakers. My question is when I am upgrading a fuse box or replacing a panel do I have to use AFCI breakers on the old work?
 
In my jurisdiction if you do not add any circuits that require AFCI protection you do not have to install AFCI's when you change a service. However check with the local AHJ.

I do not require it on service upgrades unless a new circuit is added.
 
In Mass we had this

(C) Overcurrent Device Replacements. Where panelboards are replaced that contain one or
more circuits requiring AFCI protection by this or other sections of the Code, AFCI protection shall be provided for such circuits.
Exception: For panel board replacements made before January 1, 2005, AFCI protection shall not be required on existing circuit branches.
But it seems to have been dropped as the 2008 mass code no longer has this section,.
