On a service panel, it was listed that all feeders and breakers over 90 amps must be copper. However the 100 amp breaker was listed as CU/AL and the feeder was aluminum. Does this then fail by the listing of the panel?

Ah, I notice that you're a home inspector. That means that you have pictures. Show me...

Actually, I don't have a picture. This was a question posed to me from another inspector and I had the same hope. In concept what do you think? It would seem to me that if we assume (always hazardous) that the breaker was listed as CU/AL and matches the panel brand, the only real concern would be was paste used and is the panel periodically inspected. Am I way off here?

Right here.
I'm not sure I've ever seen a lug on a panel or a breaker in which "paste" of any sort was required for an aluminium termination. Some installers do prefer to use anti-oxidant compound on such terminations because it gives them a warm, fuzzy feeling.

Well,
Why did the gentleman go figure out what was on the other end?
I've never seen that on a CAN, nickel to a dime the installer didn't either.
