ATS located ajacent to panel

It's not service rated but it it's directly beside the panel.
By code does there need to be protection between the meter base and the ATS?

If the ATS is not service rated then it needs a service disconnecting means ahead of it - which will provide overcurrent protection.

If the ATS is service rated - it is the service disconnecting means.
