automatic lighting shutoff requirement

Recent energy code requires automatic lighting shutoff in building with certain square footage. Does anyone run into inspector require automatic lighting shutoff inside patient rooms? It doesn't make any sense if we apply this for patient room at all. How do we avoid this or argue with code inspector? However, we have to comply with Comcheck and the software doesn't have exception for patient room lighting from automatic shutoff. Thanks!

9.4.1.1 - Automatic Lighting Shutoff
Exception to 9.4.1.1: The following shall not require an automatic control device:
(a) Lighting intended for 24-hour operation
(b) Lighting in spaces where patient care is rendered.
(c) Spaces where an automatic shutoff would endanger the safety or security of the room or building occupant(s).
 
Going along with what Mr. Bill posted, if the IECC is the applicable energy code, Section 505.2.2.2 covers the requirement for automatic shutoff. That section also has an exception for spaces where patient care is directly provided
