Did any code say that automatic transfer switch need to be on the same floor as emergency generator if it is not on cellar or basement?
 
No.

But may I offer the suggestion that we all get in the habit of using the phrase, "backup generator," rather than "emergency generator," when we are speaking in general terms? The word "emergency" brings into play a number of requirements that might not apply to your situation. If it is not under article 700, it is not an "emergency generator."

Good comment CB. If this is an article 700 generator the transfer switch must be in the same room as the generator (2017 NEC)
The type of generator required, emergency, standby or optional standby is determined by the building official. The NEC covers the wiring to and from the generator.
An emergency generator is painted red (OK orange in WA) and has a lot of onerous rules.
I suggest you read the scope in 700.1, .2, .3
 
NFPA 110 determines the requirements of emergency transfer switches. I don't know if that is one of the requirements or not without reviewing it.
I don't see anything in a quick review of NFPA 110, and Tom cited a 2017 NEC change that required the generator and transfer switch to be in the same room.
