Bath tub area

A wall sconce is not prohibited from being installed within the bathtub and shower area, but the luminaire must be listed for a damp location or a wet location if subject to shower spray.

Take a look at 410.4(D)

From the Hand Book, Please note signature.

"The intent of 410.4 (D) is to keep cord-connected, hanging, or pendant luminaries and suspended fans out of the reach of an individuals standing on a bathtub rim."
 
If i remember correctly it was not intended that fixtures outside of the tub or shower needed to be damp located within 3' of the tub or shower. This will change in the 2008 NEC.

Yes, the 2008 NEC text of 410.4(D) will now state:

"Luminaires located within the actual outside
dimension of the bathtub or shower to a height of 2.5 m (8 ft)
vertically from the top of the bathtub rim or shower threshold
shall be marked for damp locations, or marked for wet locations
where subject to shower spray."
