The last sentence of 410.4(D) states:

Luminaires (lighting fixtures) located in this zone (3 ft horizontal and 8 feet verticle from the top of the bathtub rim or shower stall threshold) shall be listed for damp locations, or listed for wet locations where subject to shower spray.

So does that mean that in the 2008 you wouldn't need a damp location fixture if it's less than 3' from the tub?
 
Thats correct...the damp/wet location issue will only apply if the light is in the physical footprint of the tub/shower.

The three foot prohibition for suspended luminaires, track, fans, etc. will remain, however.

“(D) Bathtub and Shower Areas. No parts of cord-connected luminaires (fixtures), chain-, cable-, or cord-suspended-luminaires (fixtures), lighting
track, pendants, or ceiling-suspended (paddle) fans shall be located within a space measured 900 mm (3 ft) horizontally and 2.5 m (8 ft) vertically from the top of the bathtub rim or shower stall threshold. This zone is all encompassing and includes the space directly over the tub or shower stall.
Luminaires (lighting fixtures) located in this space within the actual outside dimension of the bathtub or shower to a height of 2.5 m (8 ft) vertically from
the top of the bathtub rim or shower threshold shall.

There was nothing in the ROC for this, so it remains accepted.

No, it is still prohibited to install suspended luminaires, and track, fans, etc.

Here is the ROP draft text:
(D) Bathtub and Shower Areas. No parts of cordconnected luminaires, chain-, cable-, or cord-suspended luminaires,
lighting track, pendants, or ceiling-suspended (paddle) fans shall be located within a zone measured
900 mm (3 ft) horizontally and 2.5 m (8 ft) vertically from the top of the bathtub rim or shower stall threshold. This zone is
all encompassing and includes the space directly over the tub or shower stall. Luminaires located within the actual outside
dimension of the bathtub or shower to a height of 2.5 m (8 ft) vertically from the top of the bathtub rim or shower threshold
