Branch ckts and feeders

I was looking at a 6x6 gutter. Branch ckts came throuh the back of the gutter from other side of wall. Feeder wires come from 3" into top of gutter and all wire enter cabinet in 4" Nipple. Is this leagal? And can you refference the articles so I can look them up. Also the branck ckts enter from back and do not run in gutter for more than 1ft before going down 4inch. Do you need to derate? probally 50 ckts.
Derating #10 thhn do I use 40 amps from 310.16 or 30 amps?

It seems like you have a 2 part question. the first seems to be about mixing feeder and BC wiring in the same nipple. I don't see how that is a violation.

The second seems to be about derating. I would say despite what appears to be a silly requirement, you may well have to derate the conductors inside the gutter to meet code.

just curious - are all the BC conductors exiting the gutter in the same conduit?
