if you are calling this an appliance, where in the code is an appliance required to be listed at all?

I wouldn't call it an appliance. Its basically custom casework, with a panel or loadcenter wired to some kitchen equipment.

I think it should be treated just like any other premsis wiring that the on-site electrician does. Just because they wire it before they bring it in the door doesn't mean its exempt from the code.

Which is the way it should be. If it doesn't meet code and is not listed as a unit it is still subject to inspection on the premesis where it is installed. You can run into this with any equipment fabricated on or off site, even entire buildings fabricated off site.

so if the factory had put a plug and cord on it, it would be ok?
Probably not, unless the whole thing had a listing.
