To a point..the seller (if he values his rating) should be assisiting you in locating the second package. If he refuses to assist, then returning the one part you got and asking for a refund is not out of line. But you may end up with egg on your face if that second package shows up after you've sent the first one back. :) And don't expect the seller to re-send the first on his nickle if you decide to keep the item when that second box shows up.

And, BTW, you would be obligated to return it on your nickle or be liable to pay for the item anyway.

I realize from the posts that the OP was up against a deadline to use the item, but shipping errors are a hazard of buying ANYTHING online, regardless of where you bought it. If you need something on a hard deadline, buy locally or take your chances.

As a seller, in this situation I would have expected the buyer to tell me within two days of the first package arriving that the second was missing..I also email the tracking numbers for all packages the same day I ship, so thre buyer can track the progress of his shipments.

In summary, before returning the first package, I'd work with the shipping company and the seller to find out what happened to the second.

Despite some member's negative comments about ebay, I have used it for over 5 years now as both a buyer and seller and have had very good results and a 100% feedback rating. :)

If the seller purchased delivery confirmation, he has no further obligation at this point. That's the purpose of DC.... to make sure the package gets delivered. If it was purchased, he's got proof he sent it, and now the OPs beef is with the shipper.

You're right, I missed that in the OP's response.

A responisble seller would still asssit in trying to locate the missing box though.
 
If you purchased insurance, and paid via PayPal, then you're covered. It just depends on who ponies up first. PayPal will gaurantee up to $2K, and that would be the first (and probably quickest) option.

Another fly in the ointment is if you paid the seller for insurance, but the seller didn't purchase it.....:mad:

Besides, the seller listed a money-back guarantee.

Did you check with the company that he paid to ship? Was it insured? Something this expensive should absolutely been negotiated to be insured.

Let us know what the final outcome is. If it was 1 of 2, and 2 of 2, the shipper has to have some record of the two packages. I'm assuming you went with FedEx, DHL, or UPS.

What about waiting 2 weeks for a COMPLETE item.. he was paid in full the day the sale ended on 9/26. It is not my fault he sent the MAXIS in 2 seperate boxes and one box is missing.

The first box was sent USPS.. Priority mail. Seems to me he is stalling for time so I can't get a refund.

well if it was sent UPS then where is the tracking number? also, if you call ups you *might* be able to get them to tell you if you have a package on the way
 
I never got a tracking number from the seller. I filed a complaint with PAYPAL and they are contacting the seller. Thanks to all for the advice:D

If nothing else, the listing does state there's a money-back guarantee. Either way, since you paid with PayPal, you're covered if he didn't get a tracking number.
 
There should be a Tracking Number on the one box already recieved. UPS is always cooperative, at least in my experience, and they should be able to absolutely tell if there is a second box tied to the shipment. If there is not, then the seller is playing games.

Never did respond back - was the package insured? The only issue here is, the insurance may be paid to the "shippper".

When I get something like this, I insist the shipper puts the insurance in the name of the receiver. I've got quite a few things this way, and actually one was lossed. Paid in full for the amount insured for. It did take some time, as they had to investigate.

Then the lack of a second signature proves the second package was not delivered.

I just sent word to PAYPAL I want a full refund. Seller blames US mail service and says I am " NOT BEING RESONABLE" He wants me to wait another 7-10 days for other package. I told PAYPAL that no where in sellers sales pitch does it say shipping will take more than 3 weeks. I would not of bid on item if I knew this..would you????
