C-Tap inside Transfer Switch

Is it acceptable to c-tap inside of a automatic transfer switch? We are being asked to c-tap a set of #6awg off of #4/0awg to feed a 60a disconnect feeding a surge suppressor. Our electricians typically install a j-box and splice in there using polaris connectors prior to entering the ATS. This just doesn't seem right or safe? 312.8 says not to, but then it says as long as there is space?

this is what the 2011 NEC says.

The wiring
space of enclosures for switches or overcurrent devices
shall be permitted for conductors feeding through, spliced,
or tapping off to other enclosures, switches, or overcurrent
devices

I don't see any prohibition there at all subject to the conditions that follow.
