does the code say receptacles located in listed assemblies dont need to be GFCI protected? maybe its a loophole and needs to be put into the code. maybe as an exception that allows those receptacles to non gfci protected.

If they're in the bathroom they need GFI protection. But very few manufacturers make them these days because of the GFI and 20a bath circuit requirements.

I meant the receptacles in the vent fan, or heat/vent/light assemblies. Besides, they're not even IN the bathroom, just accessible FROM the bathroom. They're actually located in the joist cavity...

Exactly by point. All of the switches we put in are in cavities and have a cover. Never assume that the fan is in ceiling, might be in wall and within reach. If noisy might get unpluged and user might see this as a much needed outlet. One duplex receptacle is not always enough. Pull plastic cover out a little (no tools needed) plug in that $1 cord from big orange and problem solved , or started depending on how we view it.
