Give me the code reference citing the violation.

2005 NEC
314.27(C)
Floor Boxes
Boxes listed specifically for this application shall be used for receptacles located in the floor.

The exception to that code above allows a non-listed floorbox to be used if it is deemed by the AHJ to not be a hazard if it is installed for a specific purpose. While this is technically on the floor, I feel a violation was created when the ice cream cooler this was installed for was removed. I can't find the code I was reading earlier while searching this that mentioned possible hazards from immersion, splashes, and contact with chemical cleaning agents (such as cleaning the floor). What do you think, violation or not?

I don't see this box as complying with 406.8 (D) as the box is mounted on the floor without standpipes.
How do you know? Got X-ray vision? That box might get busted up with a buffer, but I believe the receptacle will fare just fine.
