Cleaning up grandfather's wiring

Hi Folks.

Long time lurker, first time poster. I began segregating my house's basement ('built in '83) into a separate dwelling unit about a year ago. I picked up an '08 book (even though it hasn't been adopted here yet) and have been busy ever since.

Anyway, the subject of my post is large, detached single car garage located about 100' from the dwelling structure. My grandfather (in his infinite craftiness) ran a UF 10-3 and a NM12-2 out to the garage. The 10-3 is on a 30A, the 12-2 on a 12A in the main house panel. There are primarily lights/recept on the 12-2, and a compressor/saw on the 10-3. The lines are contained within some sort of conduit, along with a CPVC 3/8" water line and telephone.

So help me out here - what's the best way to work with what I've got? Without looking I'm pretty sure the NM12-2 is in violation (don't all underground conductors have to be UF rated whether they're direct burial or not?). What are the rules against running water lines within the same conduit?

Oh and to add to the fun, the 12-2 is NOT protected at the garage at all, and the 10-3 is connected to a screw-in style fuse panel.
