Clearance at bussway switches

Situation:
Vertical Buss/ 100 amp and 400 amp buss disconnects mounted vertically, stacled one above the other.

Due to the difference in the depth of the switches (10") , would this constitute a violation of 110.26 (A) (3) ??

Provided the switches are associated with each other as mentioned, they are only granted 6". They have to grovel for the last 4".
