It would be nice to get a solid def of the commercial kitchen area.

210.8(B)(2) seems like a pretty good definition to me. If it's in a dwelling unit it's a residential kitchen and if it's in a commercial building, it's a commercial kitchen, not really that hard to get a grasp on. If in doubt call the local AHJ.
 
If they do 'let it slide', either get a signed, notarized letter from them, or make sure they have made such an amendment through proper adoption procedures.

If the inspector just says, 'Yeah, it's OK', and someone gets hurt later on, you're setting yourself up for a lawsuit.

Your not going to ever get an inspector to sign anything like that. And if your smart you would not want him too either. If he did you just admitted you know its a violation.
