Ok Guys, I appreciate all the help, but let me ask you this....

I was also told that I could size the ocp and conductors based on the flc that should be listed on the nameplate. Is this true? Do I Still Have to X 125%....? I'm Just hoping the customer produces the paperwork for this compressor i will then reverse engineer it for you all here when I am finished.:roll:
 
In my grasping I see 430-31 would because it uses the thermal protector (430-32(A)(3)) as the "overload device intended to protect the motor branch-circuit conductors", the breaker is only for short circuit and ground fault protection - just like in a real motor application :). So 210-21(B)(1) is met because the receptacle is not below the ampere rating of the branch-circuit (the TP).

I agree with you and your thought with the marketing junk. Maybe it's worth it to contact the manufacture to ask for their method of compliance with NEC.

Either way I don't see how this compressor complies with Article 430, 430-6(A)(1) ex 1 may be it but it would need to be "marked with both motor horsepower and full-load current". I see now I'm really just arguing for a breaker but nuisance tripping in this case would be an under-supplied circuit and I see that as a code violation, I don't think breakers jump in price until 60A though.

No normally the only item sized from the nameplate is the overloads 430-6(A)(2) & 430-31. All the other components for the circuit are supposed to be sized from the appropriate table in 430-247 through 250 as per 430-6(A)(1) which is slightly higher then the nameplate. The only way that I know of around this is with 430-6(A)(1) exception No. 3 and with this you would still multiply 250% for the OCP in keeping with 430-52

You really can circuit this compressor as per Post #15. You may call the manufacture to qualify the breaker size but NEC sizes it up to 40A, if you provide a 20A or 15A it may not hold. Heck install it and clamp on, note your start up and peak ampere when the tank fills and cycles off.
